Your Case

The most common question we hear is "what does it cost to meet you"? We provide everyone with a free initial consultation and if we are hired to represent you, you do not pay anything, including our costs, unless we recover. The next thing almost everyone wants to know is how long will their case take and what will happen. Each case is different. Some are resolved quickly and others take longer, especially if filing suit becomes necessary. Here are some things we think you might want to know:

We will help you:

  • By handling all contact and negotiations with insurance adjusters
  • By gathering your medical bills and records along with other documents to demonstrate your damages, such as lost wages, mileage, future medical bills, and damaged property
  • By pursuing all sources available to pay or reimburse you for medical expenses, including medical payments or PIP coverage
  • By working with health insurance, Medicare and Medicaid and other sources available to pay your medical expenses
  • By working with you and your medical providers to ensure valid bills are paid from settlements and to work with them to forebear collection activities as you desire
  • By preparing and trying your case if necessary, though most cases settle out of court
  • By seeking recovery for all harm caused to you or a loved one
  • By negotiating with private health insurance, medical providers, Medicaid/Medicare to seek reductions in the amount claimed for charges or for reimbursement of any benefits paid on your behalf
  • By seeking additional recovery from your insurance company, if necessary when the responsible party does not have enough insurance coverage to provide fair compensation
  • By working with your insurance company to identify and confirm any automobile insurance you might have which might help pay for your insurance and out of pocket expenses

Dealing with the insurance company—theirs and your own.

Not only do we take over all dealings with the insurance company of the at fault driver, we also work with your own. The goal of an insurance company is to settle your case quickly and for the best deal they can strike to save money. However, by acting too quickly, your rights can be lost and injured people often find out they need more treatment or surgery after their claim has been settled. By involving us as soon as possible, we can evaluate your case and work with you to make sure your case is not settled too soon. We work to make sure you have all of the benefits you purchased, such as help with medical payments and reimbursements for lost wages in your policy, but may not even know you have. We also work to confirm and, if applicable, make a claim for uninsured motorist coverage (your coverage that applies when the other party has no insurance) and underinsured motorist coverage (your coverage that applies when the other party does not have enough insurance) We make sure that if insurance is denied that the company can support that position. We also help to make sure available benefits are used to pay your bills while you are still treating or we are negotiating with the insurance company.

Most importantly, we will communicate with you. We will keep you advised of the developments of your case; answer your questions and explain your choices.

Will your case go to Court?

The vast majority of our cases settle, without a lawsuit ever being filed even if suit is filed. Over 90% of all our cases settle out of court. In cases where a fair settlement cannot be reached, filing a lawsuit is usually necessary, but is only done with our client's consent and agreement. We have tried almost 100 cases and appealed just about as many. Insurance companies know this - we used to represent their interests in legal battles. We are convinced this makes a difference in our ability to maximize our clients' recovery, which includes compensation for medical expenses, lost wages, reimbursement of rental car expenses, permanent injuries and other items for which they may be entitled to seek recovery.
